Rental Terms and Conditions

Our goal is to make hot tub rental simple and affordable. Please familiarize yourself with the terms and conditions we outlined below so you can enjoy your hot tub worry-free.

Permission to rent

The renter is responsible for securing all permissions related to the placement and use of the hot tub and the accessories at their location. The Owner assumes all permissions have been satisfied upon delivery of the hot tub and accessories.  Any fees arising from obtaining permissions or resulting from such permission or permission violations are the renter’s sole responsibility. The hot tub and accessories CANNOT be moved from the address on your contract except by an authorized TubLease Furniture Trading Co. employee.  The hot tub and the accessories are rented property owned solely by TubLease Furniture Trading Co.

Maintenance

The renter is responsible for the maintenance of the rented hot tub and accessories: cleaning, repair of minor damage from ordinary use, and any damage caused by pets.  The lessor is responsible for the following maintenance of the leased hot tub and accessories: repair of malfunctioning equipment and any damage resulting from faults in the workmanship or hot tub design that would render the hot tub not operating as rented.

Termination By Renter

At the end of the minimum rental period, the renter may at any time terminate this contract after notifying the owner five (5) days in advance in person, by telephone, by email, or WhatsApp. Otherwise, this contract will continue in force on a month-to-month basis.
If the renter terminates the rental period before the expiration date of the contract, the renter will need to pay for delivery and pickup charges (1000 AED) and half of the remaining monthly rentals. If the crane is required, an extra coat of 1000 AED will be taken out of the crane security deposit. 

Termination By Owner

This agreement shall, at the option of the owner and without notice, terminate upon the failure of the renter to make every rental payment required herein on or before the date due or by breach by the renter of any agreement, condition, or representation, or if the renter files any debtor’s rights action including bankruptcy, wage earner, etc. or if the hot tub or accessories are removed from the address of the renter as agreed.  The renter agrees to allow the owner to take immediate possession of its property, and the renter shall remain liable for all payments here under to the date of termination.

Late Charges

The renter shall pay a 100.00 AED late charge should the owner agree to accept payment if the contract is five (5) days or more past due. 

Amendment Fees

Any deletions, additions, or exchanges will be allowed with expenses incurred paid by the Renter, other than exchanges of defective merchandise. This fee is required before the service is completed.

Delivery and Removal Charges

The renter is responsible for making arrangements for us to get into your home/unit to deliver the hot tub and accessories.  If we are unable to get in or deliver as agreed, there will be a minimum charge of 300 AED to help compensate for our expenses for the trip. The delivery and removal charges are as specified in the contract, and any excess costs due to removal caused by the alteration of the hot tub’s location and accessories are to be paid by the renter.

Security deposit

The security deposit collected from the Renter will be used to cover any charges related to breach of contract and damages to the hot tub and accessories beyond normal use. Damages beyond normal use can include, but are not limited to, stains, pet hair, burns, rips/tears, etc. If damages and charges exceed the security deposit amount, the renter is responsible for any excess amount.

Additional Terms

The additional terms and conditions enumerated below are included as part of this contract.  The renter acknowledges receipt of a copy of this contract in digital or physical format.

  1. Renter shall comply with and conform to all UAE, Municipal, and other laws, ordinances, and regulations in any way relating to the possession, use, or maintenance of the rental property.
  2. This contract shall not be assigned or transferred by Renter without the Owner’s prior written consent but shall be subject to assignment by the Owner. No waiver by the Owner of any breach by Renter of any of its obligations hereunder shall be deemed to be a waiver of any subsequent breach of the same or any other obligation, nor shall any forbearance by the Owner to seek a remedy for any breach by Renter be deemed a waiver by Owner of its rights or remedies with respect to such breach.
  3. The rented property is and shall always be and remain the sole exclusive personal property of the Owner. The Renter shall have no right, title, or interest therein or to it as expressly outlined in this Rental Contract.
  4. Upon the expiration or termination of this contract, Renter shall immediately surrender possession of, and return said property to Owner; said property shall be free of any and all claims thereto by Renter or any party holding under or making any claims by virtue of Renter.
  5. In the event the Renter fails to pay in full promptly on the due date any monthly rental or other monies owing under this contract; the Renter violates or fails to abide strictly by any of the other provisions of this contract; or if the Renter becomes bankrupt, or is arrested and held in jail for more than three days, or abandons said property; or it appears that Renter has moved or is planning to move said property to another address, or has surrendered or is planning to surrender possession of it to a third party, or has otherwise defaulted hereunder; then upon the happening of any one of the said events, Owner shall have the right forthwith and without prior notice to enter any premises where said property is located and take immediate possession of said property without the necessity of any legal or judicial process; and Renter shall be obligated to reimburse Owner for all expenses related to any reasonable effort to repossess its property including reasonable attorney’s fees.
  6. The laws of the UAE govern this agreement and shall inure to the benefit of the assigns of the Owner.
  7. The renter agrees to pay all fees levied upon them as a consequence of the use or possession of the property.
